What are the Requirements for US Immigration?

A US immigration petition is an appeal to live and work permanently in the United States. If you are planning to become an immigrant based on permanent employment in the country, then you are allowed to apply for a US immigration petition. The US immigration petition for workers is further classified into four categories. Each category may require another type of requirement or application. What you need to do is classify yourself into what category you belong.

The EB-1 Priority workers are the foreign nationals of extraordinary ability in the sciences, arts, education, business or athletics. They can be researchers, professors, executives, and the like. The EB-2 Professionals on the other hand are those with advanced degrees and exceptional abilities. The EB-3 Skilled or Professional workers are professionals with Bachelor’s degrees. EB-4 Special Immigrants are especially for the national religious workers and former employees of the US government abroad.

Now, once you classify among those four groups, most of the categories will require a labor certification request. Your employer must complete the labor certification request or Form ETA 750. They need to submit that to the Department of Labor’s Employment and Training Administration. Once the labor certification is approved, the form I-140 must be filled and submitted to the USCIS.

For EB-4 workers, the form I-360 is used. Again, the employer must file this petition as the sponsor or petitioner. When the I-140 is approved, the beneficiary or the employee, is given an immigrant visa number. When given the number, the applicant must apply to adjust to permanent resident status if they are already in the country. They must file the I-485. If outside the country, then the process must be completed at the local US consulate office.
