Work permits in the US are divided into two major categories: permits for those planning on immigrating as workers, and permits for those who are intending to work in the US on a temporary basis.

For those coming to work in the US as permanent immigrants, the different kinds of work permits are prioritized into five categories, EB-1 to EB-5. EB-1 applicants take first priority, followed by EB-2 with second priority, and so on.

EB-1 is the category for applicants that are exceptionally talented individuals. This category of work permit is intended for those at the very top of their field. Successful applicants are often internationally honored for their talents or achievements. Noted scientists, entertainers, athletes or other exceptional individuals may apply for an EB-1 permit. Top-level managers of multi-national corporations may also be considered for this type of work permit.

EB-2 applies to highly trained or educated immigrants. This category includes applicants who hold advanced degrees such as doctorates, or who possess unusual or highly developed talents deemed by USCIS (US Citizenship and Immigration Services) to be beneficial to the US in economic, cultural, or educational terms.

EB-3 applicants are skilled and unskilled workers, as well as professionals. Unskilled workers qualify for this category when there are not enough suitable US resident applicants available to fill all open positions.

EB-4 applicants are typically coming to the US to work in religious vocations. It is required that the applicant come to work at the request of a US-based non-profit religious organization, and that the applicant have been a member of that organization for at least two years prior to application.

EB-5 is the designation for those wishing to enter the US to pursue entrepreneurial opportunities inside the US who are able to contribute capital and create jobs for US residents.

Those entering the US to work temporarily in a specialist capacity should apply for an HB-1 category work permit. To qualify, applicants should be highly trained and educated in their field, as well as have a great deal of practical experience. A bachelor’s or equivalent degree is typically required, and these permits are most commonly extendable for up to six years.
